Private Membership Terms & Conditions
SECTION 1: DEFINITIONS
This agreement (“Agreement”) outlines the terms of membership with The Cove, a private social club.
- Definitions:
- “The Cove” refers to the club located at 1349 North Market Street.
- “Member” refers to the applicant executing this Agreement.
- “Guest” means any individual accompanying a Member.
- “House Rules” are the official code of conduct and usage policies of the Club.
- “Club Facilities” includes all spaces and amenities within The Cove.
SECTION 2: MEMBERSHIP & ELIGIBILITY
- Membership is by application and subject to committee approval.
- Membership is non-transferable and non-refundable.
- Members must be 21+ years of age unless otherwise permitted.
- All dues are billed in advance according to the chosen plan.
SECTION 3: HOUSE RULES & CLUB CONDUCT
- Dress Code: Jackets encouraged for gentlemen; cocktail or business attire for ladies. Denim, shorts, and sweats are not permitted
- Phones & devices may be used silently in designated business or private rooms only
- No recording, photography, or live-streaming without clear consent.
- Pets: Only certified service animals allowed.
SECTION 4: GUEST POLICY
- Select membership plans include access to (1) designated guest.
- Guests must remain with their host member at all times.
- Members are responsible for the behavior of their guest.
- The Cove reserves the right to refuse guest entry.
SECTION 5: BILLING, LATE PAYMENT, AND REINSTATEMENT
- Payments are due on your scheduled billing date.
- If a payment is overdue by more than (3) days, The Cove reserves the right to apply a $50 late fee to the outstanding balance. Accounts with payments overdue by thirty (30) days or more are subject to automatic termination of membership.
- Terminated members must reapply and are not guaranteed reinstatement. Should reinstatement be approved, a reactivation fee of $250 will apply.
- All fees are non-refundable.
SECTION 6: TERMINATION & SUSPENSION
- Membership may be suspended or terminated for:
- Misconduct or violation of House Rules
- Non-payment.
- Behavior deemed disruptive or inappropriate
- Terminated members are subject to waiting list reapplication. Terminated members are not automatically eligible to return, and any reinstatement is reviewed individually.
- Outstanding balances must be settled prior to reapplying.
- If a member terminates contract (membership) after first quarterly payment, member is agreeing to an early termination fee of 50% of annual membership full price.
SECTION 7: DELINQUENT ACCOUNTS AND COLLECTION
- In the event of an unpaid balance, The Cove reserves the right to pursue any and all remedies available under law, including the engagement of third-party collection agencies and legal action, to recover outstanding dues. Members shall be responsible for any associated costs incurred during the collection process, including but not limited to reasonable attorney fees, court costs, and collection agency fees.
SECTION 8: USE OF FACILITIES & LIABILITY WAIVER
- All use of facilities is at your own risk.
- The Cove is not liable for injury, theft, loss, or damage.
- Members agree to indemnify The Cove from liability related to themselves or their guest.
SECTION 9: PRIVACY & SECURITY
- Member data is collected and stored securely.
- CCTV surveillance may be used for safety and monitoring.
- Personal data is never sold or shared without consent.
SECTION 10: ARBITRATION & DISPUTE RESOLUTION
- Any disputes will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
- Class-action suits are waived.
- Florida law shall govern this Agreement.
